Terms and Conditions for the use of the mehma platform

1. Scope

These Terms and Conditions (T&C) apply to all contracts concluded for the use of the digital platform "mehma". The platform is operated by PREFUNK Connect GmbH, Seidlgasse 21/1/EG, 1030 Vienna, Austria. By registering or using the platform, users agree to these T&C.

2. Contracting party

The contracting party is PREFUNK Connect GmbH, represented by the founders Simon Prestel and Marvin-Matthias Funke. Contact: service@mehma.at

3. Description of services

mehma is a digital platform that facilitates access to psychological support by providing AI-assisted self-help tools, matching with suitable psychotherapists and clinical psychologists, and additional informational resources. mehma itself does not provide any medical, psychotherapeutic, or psychological counselling.

All content, features, and suggestions offered on the platform do not constitute a medical or psychological diagnosis and do not replace professional treatment. The displayed topic categories are based on automated AI analyses of the text entered by the user and serve solely as an initial orientation. Diagnostic assessments may only be carried out by appropriately qualified psychological professionals. No promise of healing is made.

4. Registration and user account

To use the platform as a psychotherapist or clinical psychologist, registration is required. Users agree to provide accurate information and to keep their login credentials confidential. The platform may only be used by individuals who are at least 18 years of age. Psychotherapists and clinical psychologists are required to upload appropriate documentation during registration to verify their authorization to practice psychological or psychotherapeutic services in Austria (e.g., entry in the official list of psychotherapists or proof of professional qualification in accordance with Austrian law).

5. User obligations and prohibited content

Users agree to use the platform solely within the framework of applicable laws and these T&C. In particular, it is prohibited to upload or distribute content that:

• is offensive, discriminatory, glorifies violence, or pornographic,

• infringes copyrights or other third-party rights,

• contains medically false, misleading, or dangerous statements,

• represents commercial advertising.

PREFUNK Connect GmbH reserves the right to temporarily or permanently block user accounts in case of violations.

6. Costs and payment terms

​

Use of the platform is free of charge for individuals seeking therapy. For registered psychotherapists and clinical psychologists, the use of the platform is subject to a fee. Free use is only available within a limited trial period, the duration and scope of which are specified on the website.

Payments can be made using the following payment methods: credit and debit cards, Apple Pay, Google Pay, Link, PayPal, EPS, and Klarna. Payment processing is carried out via Stripe or PayPal. Prices and payment terms are displayed transparently on the website.

7. Right of withdrawal

Consumers have the right to withdraw from the contract within 14 days without giving any reason. For digital services that are to be provided immediately, explicit consent must be given.

8. Data protection

Information on the handling of personal data can be found in the separate Privacy Policy. Processing is carried out in compliance with GDPR. Health data is transmitted in encrypted form and treated confidentially.

9. Disclaimer of liability

mehma accepts no liability for psychological or physical harm. The platform does not replace psychotherapeutic or medical treatment. The content does not constitute therapy recommendations. The availability of the platform is aimed for but cannot be guaranteed. Maintenance work, technical malfunctions, or force majeure may lead to temporary restrictions. Liability for third-party content accessible via the platform is excluded.

10. Duties and liability of psychotherapists and clinical psychologists

​

Psychotherapists and clinical psychologists act on their own behalf and are solely responsible for the content they publish on the platform or provide in the context of any counselling or professional interactions. PREFUNK Connect GmbH assumes no liability for the services or statements of registered psychotherapists and clinical psychologists. They are required to offer only those services that fall within the scope of their legally permitted professional activities and to promptly notify PREFUNK Connect GmbH of any changes to their qualifications or professional authorization.

11. Use of third-party services

For certain functions of the platform, third-party services may be integrated (e.g., appointment scheduling, accessibility tools such as speech recognition or text-to-speech applications, as well as payment processing). The use of these services is also subject to the respective terms of use and privacy policies of the third parties.

12. Technical requirements

To use the platform, an up-to-date internet browser and a stable internet connection are required. For proper use of certain functions, additional software may need to be installed. Users are responsible for their own technical equipment.

13. Transfer of contract

PREFUNK Connect GmbH is entitled to transfer its rights and obligations under this contract in whole or in part to third parties, provided that the legitimate interests of the users are preserved.

14. Term and termination

Paid subscriptions for therapists have the chosen term (monthly, 6 or 12 months) and are automatically renewed for the same term unless terminated in writing with one month’s notice before the end of the current term.

15. Language and interpretation

These T&C are available in several language versions. In the event of contradictions or questions of interpretation, only the German version is legally binding. Translations serve only for better understanding.

16. Final provisions

Austrian law applies. The place of jurisdiction is Vienna, unless another legally required jurisdiction applies. Should any provision of these T&C be invalid, the remaining provisions remain valid. PREFUNK Connect GmbH reserves the right to change these T&C at any time. Changes will be communicated to users in good time. If they are not objected to within 14 days, they are deemed accepted.
